1. Scope
These terms govern your use of the FlashLingo app for iOS and of the website flashlingo.io. They are provided by Fabian Geistert, Adalbert-Stifter-Str. 11, 1200 Vienna, Austria ("we", "us"). You accept them when you create an account or continue as a guest in the app.
You get FlashLingo from Apple's App Store. Apple's Licensed Application End User License Agreement (the standard EULA) applies to your licence of the app, and these terms add the rules specific to FlashLingo. If the two conflict, these terms take precedence to the extent the standard EULA allows. Our Privacy Policy explains how we handle data.
2. Who can use FlashLingo
You must be at least 14 years old to use FlashLingo. You need an iPhone with a supported version of iOS. FlashLingo is intended for personal, non-commercial use.
3. What FlashLingo does
FlashLingo helps you learn vocabulary. You create sets of flashcards in the languages you learn, and the app schedules practice sessions with spaced repetition, tracks your progress and streak, and can remind you to practice. Your data is stored in your account and synced between your devices, so FlashLingo needs an internet connection for most features.
FlashLingo is a learning aid. We don't guarantee any learning outcome, and we are not responsible for the accuracy of the cards you create.
4. Your account
When you first open FlashLingo, you get a guest account. You can turn it into a full account with an email address and password or with Sign in with Apple, which lets you sign in on other devices and recover your data. A guest account is tied to the app on one device: if you delete the app, you can't get back into it, and its data is lost.
Keep your sign-in details secret and tell us if you think someone else is using your account. Your username must not impersonate others, be offensive or break the law. We may change a username that does.
5. Your content
The sets and cards you create stay yours. You grant us the non-exclusive right to store, copy and process them only as far as needed to run FlashLingo for you, for example to sync them between your devices. This right ends when you delete the content or your account. Your sets and cards are private and are not shown to other users.
You are responsible for what you put on your cards. Only add content you are allowed to use, and don't use FlashLingo to store content that is unlawful or that infringes the rights of others.
6. Licence and acceptable use
We grant you a personal, non-exclusive, non-transferable licence to use FlashLingo on Apple devices that you own or control, in line with the App Store's usage rules. You must not:
- copy, modify, decompile or reverse-engineer the app, except where the law expressly allows it
- access our servers other than through the app, or try to access other users' data
- overload, attack or misuse our servers, for example with automated requests
The app, its design and its texts are protected by copyright. Open-source components are licensed under their own terms.
7. Price
FlashLingo is currently free. If we introduce paid features, they will be sold through the App Store, and the app will show the features, prices and terms before you buy anything.
8. Changes to FlashLingo
We develop FlashLingo continuously and may change, add or remove features. We try to keep FlashLingo available at all times, but it may occasionally be unavailable, for example during maintenance or because of problems with our service providers. If we ever stop offering FlashLingo, we will tell you in advance where possible.
9. Warranty
If you are a consumer, your statutory warranty rights remain unaffected, including those for digital content and services under the Austrian Consumer Warranty Act (Verbrauchergewährleistungsgesetz). FlashLingo is provided free of charge.
10. Liability
We are liable without limitation for damage caused intentionally or through gross negligence, for personal injury, and under the Austrian Product Liability Act. For slight negligence we are not liable, except for personal injury and where mandatory law provides otherwise. Nothing in these terms limits rights that consumer protection law gives you and that cannot be excluded by contract.
11. Ending use
You can stop using FlashLingo at any time, and delete your account and all of its data in the app's settings. We may suspend or delete accounts that seriously or repeatedly break these terms, particularly sections 5 and 6. Where reasonable, we will warn you first.
12. Changes to these terms
We may update these terms, for example when FlashLingo gets new features or the law changes. The version number and date at the top show the current version. We point out significant changes in the app before they take effect. If you don't agree to them, you can stop using FlashLingo and delete your account.
13. Governing law and jurisdiction
These terms are governed by Austrian law, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you also keep the protection of the mandatory laws of the country where you habitually live. Consumers can bring claims in the courts of the country where they live. For anyone who is not a consumer, the courts of Vienna, Austria have jurisdiction.
14. Dispute resolution
If something goes wrong, please write to us first. We will try to find a solution. We are not obliged, and not willing, to take part in dispute resolution proceedings before a consumer arbitration board.
15. Final provisions
If any provision of these terms is invalid, the rest remain in force.
